In it you will find important information about the processing of your personal data, the rights recognised by the current regulations on the matter and the corresponding obligations.

We reserve the right to update our privacy policy at any time due to corporate decisions, as well as to comply with any legislative or legal changes. If you have questions or require any clarification about our Privacy Policy or your rights, please contact us via the channels indicated below.

You declare that the data you provide, now or in the future, is correct and truthful and you agree to notify us of any changes to this data. If you provide personal data from third parties, you agree to obtain the prior consent of the parties in question and inform them about the content of this policy.

In general, the mandatory fields in our forms must be completed in order to process your requests.

  1. Who is the data controller responsible for processing your data?

The data controller responsible for processing the data collected on the Website is HOTELOGY S.L. (hereinafter, SMYHOTELS), with registered address at Edificio Logitravel, Parcela 3B (Parc Bit) - Ctra. Palma - Valldemossa km 7.4, 07121 Palma de Mallorca, Spain.

  1. Why do we process your data?

Our users' data will be processed for the management of our relations with them, for the processing and commercial monitoring of their bookings, the provision of requested services, dealing with their requests and queries, the administration and the management of online security and the fulfilment of our legal obligations. This data will also be used for analytical purposes and to improve the quality of our services. This includes the analysis of consolidated booking data processed through the Website.

Data obtained from social profiles for managing the user registration process will be used only for that purpose and for the relationship with those users of our website.

In addition, we advise you that a commercial profile will be created from the data provided on the Website and on Booking Platforms in order to offer a personalised service in the provision of the requested services and to send you commercial offers tailored to that profile. Automated decisions will not be made based on the profiles of our customers. The personalisation of services requires your consent for hotels in the SMYHOTELS group with which you contact in the future for the contracting or rendering of services to access such data. You also consent to the international transfer of your data, when such establishments are outside of the European Economic Area.

Similarly, your data will be processed for marketing purposes and commercial mailings related to products and services provided by the Logitravel Group, in relation to tourism, the automotive industry, leisure, art, culture, education, telecommunications, finance and insurance.

  1. To whom may we disclose your data?

Your data will only be communicated to third parties by legal obligation, with your consent, or when your request requires such communication. For example, for the correct processing of a booking, the data provided must be communicated to the destination hotel included in your booking. This includes the communication to said hotel of the bank card data that has been provided in the reservation to attend to the possible penalties for cancellations or non-presentation fixed in the rate terms and conditions. The processing of your reservations requires the aforementioned process, and therefore the process cannot be carried out if you object to this.

  1. Legal basis for processing

The legal basis for the processing of your data is the management of the legal relationship established with you, the provision of requested or contracted services, and compliance with legal obligations, especially those applicable to accounting, taxation and tourism.

The management of the security of the Website and of the Booking Platforms is based on the existence of a legitimate interest. The analysis of consolidated customer data, the keeping of statistics and the realisation of quality control, the commercial tracking of your requests and the sending of commercial communications are based on our legitimate interest for internal administrative purposes, as well as in evaluating and promoting our services.

The creation of commercial profiles, the personalisation of services, the management of registration and user login data through social profiles and the sending of offers and personalised commercial communications are based on the consent that is requested, with the withdrawal of said consent not affecting contracted services.

  1. For how long will we retain your data?

In general, we retain your data throughout the validity of the relationship you have with us and, in any event, throughout the periods provided in applicable legal provisions, such as accounting and tax matters, and for the time necessary to meet potential liabilities arising from the processing of such data. We will erase your data when it is no longer necessary or relevant for the purposes for which it was collected.

Access logs for restricted areas of the Website will be deleted one month after their creation. Information on browsing will be removed once the website connection has been completed and the statistics compiled.

The data processed for commercial purposes, including commercial profiles, will remain valid until its deletion is requested. For supports for which there is user consent to the transmission of their data for these purposes, for example, logs of electronic formulae sent, will be kept for the entire duration of processing and the applicable legal terms.

  1. What are your rights?

You have the right to obtain confirmation about whether or not we are processing your personal data and, if we are, to access such data. You may also ask for your data to be rectified if it is inaccurate or incomplete. In addition, you may request the erasure of your data if, among other reasons, it is no longer necessary for the purposes for which it was collected.

In certain circumstances, you may request limitations upon the processing of your data. In this case, we will only process the data in question for the formulation, exercise or defence of claims or with a view to protecting the rights of other persons. Under certain conditions, and for reasons related to your particular situation, you may also object to the processing of your data. Similarly, and under certain conditions, you may request your data in a portable form for it to be transferred to another data controller.
